Environmental Insurance Coverage
As environmental liabilities have increased, Ice Miller has assisted its clients in their efforts to obtain insurance or other indemnification for these liabilities. As of October 2007, Ice Miller has appeared as counsel of record in ninety-three (93) reported opinions in cases involving insurance coverage or insurance issues. Recent examples of the Firm’s work in this area include:
- pursuing coverage claims for fifteen (15) dry cleaners that are seeking coverage for underlying liability claims arising out of soil and groundwater contaminations from historic dry cleaning operations
- pursuing coverage claims for real estate developer regarding environmental liabilities due to soil and groundwater contamination
- representing Indiana municipalities that are seeking insurance recoveries to help fund brownfields redevelopment projects
- pursuing insurance proceeds for a company which paid millions of dollars for claims arising out of a massive fish kill in a major Indiana waterway
- pursuing liability coverage for the former operator of above-ground storage tanks which allegedly leaked and caused soil and groundwater contamination
- pursuing liability coverage for a food manufacturer that faced significant environmental liability for contamination allegedly emanating from former underground storage tanks.
