Hazardous Materials - Handling and Transportation

Ice Miller represents a variety of clients in the transportation of hazardous materials by rail, truck, water, air and pipeline. We have advised our clients as to the manner in which numerous laws and regulations regulate this area, including RCRA, CERCLA, EPCRA, the Clean Water Act, Safe Drinking Water Act, TSCA the Clean Air Act, various provisions of Federal Hazardous Materials Transportation Law, and OSHA. We have also assisted clients in complying with the Hazardous Materials Requirements ("HMR") and have defended several HMR enforcement actions. Ice Miller has helped clients identify which materials being shipped by the client qualify as hazardous materials and advised them regarding hazard communication programs, special packaging and labeling requirements, quantity limits, operational rules, registration, and employee training requirements. Ice Miller has handled enforcement and compliance matters involving the Federal Highway Administration (FHWA), the United States Coast Guard (USCG), the Federal Railroad Administration (FRA), and the Federal Aviation Administration (FAA).
